Terms of service
Welcome to Uykumo.
These Terms of Service (“Terms”) govern your access to and use of the Uykumo website, as well as all purchases made through our online store.
Throughout these Terms, the words “Uykumo”, “we”, “us” and “our” refer to Uykumo, a business established in the Netherlands.
By visiting our website, placing an order, purchasing a product or otherwise using our services, you agree to these Terms.
Please read these Terms carefully before using our website or placing an order.
If you do not agree with these Terms, you should not use our website or purchase our products.
1. About Uykumo
Uykumo is an online retailer offering consumer products, including products designed for nighttime use and sleeping routines.
Our products are intended for personal consumer use unless otherwise stated.
Product descriptions, instructions, warnings and other information provided on our website form part of the information available to you before purchasing a product.
2. Eligibility to Purchase
By placing an order through our website, you confirm that:
-
you are legally capable of entering into a binding purchase agreement;
-
the information you provide is accurate and complete;
-
you are authorised to use the selected payment method; and
-
you are purchasing the products for lawful purposes.
If you are under the legal age required to enter into a contract in your country, an order should be placed by or with the permission of a parent or legal guardian.
3. Product Information
We aim to describe and display our products as accurately as reasonably possible.
However, colours, packaging, dimensions and appearance may differ slightly from images shown on the website due to differences in screens, photography, manufacturing batches or packaging updates.
Product images are primarily illustrative.
The packaging or presentation of a product may be updated without materially changing the product itself.
You are responsible for reading all product descriptions, usage instructions and warnings before using a product.
4. Uykumo Mouth Tape and Product Use
Uykumo mouth tape is intended as a consumer wellness product for use during sleep.
It is not intended to diagnose, treat, cure or prevent any medical condition and should not be considered a substitute for professional medical advice, diagnosis or treatment.
Customers are responsible for determining whether the product is suitable for them.
Do not use the product contrary to the instructions or warnings provided with the product or on our website.
If you experience difficulty breathing, significant discomfort, skin irritation or another adverse reaction, discontinue use.
If you have questions regarding whether a product is appropriate in light of a medical condition, medication or other health circumstance, you should seek advice from an appropriately qualified healthcare professional before use.
5. Availability
All orders are subject to availability.
Adding an item to your shopping cart does not reserve the item.
In rare circumstances, a product may become unavailable after an order has been submitted.
If we are unable to supply a product you ordered, we may:
-
contact you to offer an alternative;
-
postpone fulfilment with your agreement; or
-
cancel the affected product and refund the amount paid for it.
6. Prices
Prices displayed on our website are shown in the currency selected or displayed on the website.
The total amount payable will be shown before you complete your order.
Where applicable, prices offered to consumers include VAT or other taxes as required by applicable law.
Shipping costs and any other applicable charges will be displayed during checkout before the order is confirmed.
For international orders, local authorities may impose import taxes, customs duties or other charges depending on the destination.
Where such charges are not collected by Uykumo during checkout, they may remain the responsibility of the recipient.
7. Orders
Your order represents an offer to purchase products from Uykumo.
After submitting an order, you will normally receive an electronic order confirmation.
Receiving an automated confirmation does not prevent us from cancelling an order in circumstances permitted by law, including where:
-
a product is unavailable;
-
an obvious pricing or technical error occurred;
-
payment cannot be authorised;
-
we reasonably suspect fraud or misuse;
-
shipping to the supplied address is not reasonably possible; or
-
the order violates applicable law or these Terms.
If we cancel an order after payment has been received, the relevant amount will be refunded.
8. Payment
Available payment methods are displayed during checkout.
Payment must be successfully authorised before we are required to dispatch an order.
By selecting a payment method, you confirm that you are authorised to use that method.
Depending on your bank, card issuer or payment provider, additional verification may be required.
Uykumo is not responsible for fees separately charged to you by your bank, card issuer, payment provider or currency conversion provider.
9. Delivery
We deliver to the countries and regions made available during checkout.
Estimated delivery times may be displayed on our website or during checkout.
Delivery estimates are indicative unless expressly stated otherwise.
Actual delivery times may be affected by circumstances outside our reasonable control, including:
-
customs procedures;
-
carrier delays;
-
adverse weather;
-
public holidays;
-
incorrect delivery information;
-
unusually high order volumes; or
-
other logistical disruptions.
You are responsible for providing a complete and accurate delivery address.
If an order cannot be delivered because incorrect or incomplete information was supplied, additional shipping costs for resending the order may be charged where permitted by law.
10. Transfer of Risk
For consumer purchases where applicable consumer law applies, the risk of accidental loss or damage generally transfers to you when you, or a person designated by you other than the carrier, receives the goods.
Nothing in these Terms limits any mandatory consumer rights that apply to your purchase.
11. Right of Withdrawal and Returns
Where applicable law grants you a statutory withdrawal period for online purchases, you may exercise this right within the legally applicable period.
For consumers within the European Union, this will generally be 14 days from receipt of the goods, subject to applicable legal exceptions.
To exercise a right of withdrawal, contact us at:
Please clearly state your order number and your intention to withdraw from the purchase.
12. Hygiene and Sealed Products
Certain Uykumo products are intended for personal use and may come into direct contact with the mouth, lips or skin.
Where permitted by applicable law, products that are:
-
sealed for health protection or hygiene reasons; and
-
unsealed by the customer after delivery
may not be eligible for return under the statutory right of withdrawal.
This exception only applies where the legal requirements for the hygiene exception are met.
Unopened and otherwise eligible products may still be returned in accordance with our Refund Policy and applicable consumer law.
13. Return Shipping
Unless we state otherwise or the product is defective or incorrect, you may be responsible for the direct costs of returning an unwanted product where permitted by law.
Products should be returned securely packaged and, where reasonably possible, with shipment tracking.
You remain responsible for the return shipment until it reaches us, except where applicable law provides otherwise.
Additional details can be found in our Refund Policy.
14. Refunds
Once an eligible return has been received and inspected, we will process the refund in accordance with applicable law and our Refund Policy.
Refunds are normally made to the original payment method.
Banking and payment providers may require additional time before a refunded amount appears in your account.
Where legally permitted, we may reduce a refund if goods have been handled beyond what was reasonably necessary to establish their nature, characteristics and functioning.
15. Incorrect, Damaged or Defective Products
Please inspect your order after receiving it.
If you receive an incorrect product, or if a product arrives damaged or defective, contact:
Please include your order number and, where helpful, photographs showing the issue.
Nothing in these Terms limits your statutory rights regarding products that do not conform to the purchase agreement.
16. Promotions and Discount Codes
From time to time Uykumo may offer promotional discounts, discount codes or special offers.
Unless otherwise stated:
-
promotions cannot be combined;
-
promotional codes have no cash value;
-
promotional codes may have an expiration date;
-
discounts apply only to eligible products; and
-
promotions may be limited to specific regions, customers, quantities or periods.
We may refuse use of a promotional code where we reasonably believe it is being abused, fraudulently reproduced or used contrary to the stated promotion conditions.
This does not affect orders already validly concluded where cancellation would not be permitted by law.
17. Subscriptions
If Uykumo offers subscription purchases, the applicable price, billing frequency, renewal terms and cancellation options will be displayed before you subscribe.
By purchasing a subscription, you authorise recurring payments according to the subscription option selected by you until the subscription is cancelled.
You may cancel a subscription through the cancellation method made available by Uykumo.
Cancellation prevents future renewals but does not normally retroactively cancel an order that has already been processed, except where applicable law provides otherwise.
18. Intellectual Property
Unless otherwise stated, all content available through the Uykumo website is owned by or licensed to Uykumo.
This includes, without limitation:
-
the Uykumo name;
-

-

other original content.
You may use the website for personal and non-commercial purposes.
You may not reproduce, distribute, sell, commercially exploit, modify or republish our protected content without our prior written permission, except where permitted by law.
19. User Reviews and Submitted Content
Where our website allows customers to submit reviews, photographs, comments or other content, you remain responsible for the content you submit.
You must not submit material that:
-
is knowingly false or misleading;
-
infringes another person's intellectual property;
-
contains unlawful or defamatory material;
-
contains malicious code;
-

-
constitutes spam or unauthorised advertising.
By submitting content for publication, you grant Uykumo a non-exclusive licence to use, reproduce, display and publish that content for purposes related to our website, business and marketing, to the extent permitted by applicable law.
We may moderate or remove content where reasonably necessary.
We do not promise to publish every submitted review.
We will not knowingly manipulate customer reviews in a manner that misleads consumers regarding genuine customer experiences.
20. Website Availability
We aim to keep our website available and functioning correctly.
However, we do not guarantee that the website will always operate uninterrupted or without errors.
We may temporarily suspend access for maintenance, security, technical improvements or circumstances beyond our reasonable control.
21. Third-Party Services
Our website may rely on third parties for services including:
-
payment processing;
-
logistics;
-
analytics;
-
website functionality;
-
customer communication; and
-
other technical services.
Links to third-party websites may also appear on our website.
A link to another website does not necessarily mean that Uykumo controls or endorses all content or practices of that third party.
Third parties may operate under their own terms and privacy policies.
22. Account Security
If our website allows you to create an account, you are responsible for maintaining the confidentiality of your login information.
You should notify us if you reasonably believe your account has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to protect the customer, Uykumo or other users from fraud, security threats or misuse.
23. Prohibited Use
You may not use our website:
-
for unlawful purposes;
-
to infringe intellectual property rights;
-
to distribute malware or harmful code;
-
to attempt unauthorised access to systems or information;
-
to interfere with website security;
-
to collect personal information unlawfully;
-
to commit or facilitate fraud;
-
to submit intentionally false information; or
-
to use automated systems in a manner that materially interferes with normal operation of the website.
We may restrict access where reasonably necessary to protect our website or users.
24. Limitation of Liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
To the maximum extent legally permitted, Uykumo will not be liable for indirect or consequential losses that were not reasonably foreseeable when the purchase agreement was concluded.
Uykumo is not responsible for losses resulting from:
-
use contrary to product instructions;
-
unauthorised modification of a product;
-
circumstances outside our reasonable control; or
-
incorrect information supplied by the customer,
except where applicable law requires otherwise.
These Terms do not exclude statutory consumer rights.
25. Force Majeure
Uykumo will not be responsible for delay or failure to perform an obligation where performance is prevented by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, war, civil disturbance, government restrictions, strikes, transport disruptions, customs delays, infrastructure failures or significant failures of third-party services.
Any mandatory consumer rights remain unaffected.
26. Privacy
Your privacy is important to us.
Personal information is processed in accordance with our Privacy Policy and applicable data protection laws.
Our Privacy Policy explains the categories of information we collect, why we process them, how long they may be retained and your applicable privacy rights.
Please review our Privacy Policy separately.
27. Cookies
Our website may use cookies and similar technologies for necessary website functionality and, subject to applicable requirements, analytics, preferences and advertising.
Additional information can be found in our Privacy Policy and/or Cookie Policy.
Where legally required, non-essential cookies will only be used after the appropriate consent has been obtained.
28. Complaints
We want to resolve legitimate customer concerns fairly and efficiently.
If you have a complaint regarding your order or our service, contact:
Please provide sufficient information for us to identify your order and understand the issue.
We will endeavour to respond within a reasonable period.
Your statutory rights regarding complaints and consumer remedies remain unaffected.
29. Changes to These Terms
We may update these Terms from time to time, for example because of:
-
changes to our business;
-
new services or products;
-
changes in applicable law;
-
security requirements; or
-
technical developments.
The version applicable to an order is generally the version that was made available when the relevant purchase was concluded.
Material changes will not retrospectively remove rights that you already acquired under an existing agreement.
The latest version will be published on this website together with its update date.
30. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Where appropriate, an invalid provision will be interpreted or replaced in a way that most closely reflects its lawful intended purpose.
31. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean we permanently waive our right to enforce it later.
32. Governing Law
These Terms and purchase agreements with Uykumo are governed by the laws of the Netherlands, unless mandatory consumer protection legislation provides otherwise.
If you are a consumer residing in another country, you continue to benefit from mandatory consumer protection rights that cannot lawfully be excluded by choosing Dutch law.
Any dispute will be submitted to a competent court in accordance with applicable jurisdiction rules.
